Debt Collection & Judgment Enforcement
Helping individuals and businesses recover unpaid debts and enforce Ontario judgments.
Winning a court judgment does not actually mean getting paid
Courts won’t find money for you. If a judgment debtor doesn’t cooperate, it is up to the judgment creditor to turn their judgment into money. This may necessitate garnishing a bank account or wages, filing a writ against property, or requiring the debtor to attend an examination and answer questions about their income and assets. Time is of the essence, and this process is particularly burdensome where the creditor lives abroad.
How I Can Help
Before Judgment
I can review the debt and supporting documents, assess the prospects of recovery, negotiate a payment plan, or pursue a claim, as relevant to your specific case.
After Judgment
I will help you identify useful information about the debtor, pursue bank or wage garnishment, an examination hearing, or a writ, as necessary.
FAQ
What if I don’t know where the debtor banks or works?
You may still have options. An examination hearing can require the debtor to answer questions about their income, property, debts and financial transactions. I will thoroughly review the information you already have to decide which enforcement steps are worth pursuing.
Can I garnish someone’s wages or bank account?
Potentially. Garnishment can be used to seek payment from a third party, such as an employer or bank, that owes money to the debtor. Whether it will recover anything depends on the debtor’s circumstances and the applicable rules.
Can you help if I live outside Ontario?
Yes. If you have an Ontario judgment, you do not need to be physically present in Ontario to discuss and pursue enforcement options. I will review the judgment, the information you have about the debtor, and the steps available to you.
Is it worth enforcing my judgment?
This depends on the amount owed, the information available about the debtor, the likely cost of enforcement, and the prospect of recovery. I can help you assess those factors before you commit to a particular course of action.
